| 摘 要： | 《刑法修正案（八）》将醉酒驾驶和在道路上驾驶机动车追逐竞驶这两种行为规定为犯罪,但是危险驾驶行为入罪问题一直是备受争议的话题。在现行法律框架下,如何认定危险驾驶罪乃实务的需要。认定危险驾驶罪需要有具体的认定标准,这需要通过界定危险驾驶罪的犯罪构成来完成。文章通过对危险驾驶罪的主客观方面研究以准确认定危险驾驶罪,并指出了认定危险驾驶罪应当注意的问题。
