统一司法考试反思

尽管从理论上讲统一司法考试具有十分重要的意义,但从近五年来的实践来看,我国统一司法考试制度存在一定的局限性,从而影响了统一司法考试制度的价值实现。第一,由于现行司法考试在考试内容和题型设置方面过于强调考生的记忆能力,因此不利于选拔高质量的法律人才。第二,由于司法考试的通过率过低,造成了中西部地区司法人员断档、法律人才紧缺。第三,尽管一次性司法考试有助于节约成本,但一考定乾坤的考试未必能够选拔到真才实学的考生进入法律职业队伍。

Re-thinking of Uniform Judicial Exam

Although in theory,the uniform judicial exam has very important meaning,the system of the uniform judicial exam in China has limits to some extent,exposing from the five years' practice or so,which influences the realization of values of the system of uniform judicial exam.Firstly,it over-emphasizes the faculty of memory of the examinees in the aspect of the contents and establishment of types of topics,so it isn't beneficial to select legally talented persons with high quality.Secondly,the passing rate of the judicial exam is too low,which results to uhe problems of lack of judicial personality and legal talented persons in the middle and west areas.Thirdly,one time-judicial exam can help save costs,but it may not succeed to select real exellent examinees and let them enter into the legal profession ranks.
