| 摘 要： | 公证遗嘱在司法实践中由于欠缺程序要件及不能排除合理怀疑而被宣布无效。因此,为了维护公证机构的权威性及公证遗嘱的公信力,公证机构应强化对公证事项的形式审查及实质审查,同时还要完善公证立法,切实维护公证市场秩序,保障公证遗嘱目的的实现。

| Abstract: | In judiciary practice,notarial testament is declared invalid for lacking process factors which can＇t eliminate rational doubt.So the notarial organization should strengthen the formal examination of notarial items and at the same time,perfect the testament legislation,verily maintain notarial market order and protect the reality of notarial testament aim to protect the authority of notarial organization and the reliability of notarial testament. |
