| 摘 要： | 法律上的法人与现实生活中的团体不是同一的,法律上的法人是法律运用法律思维构造的人,因此法人在法律上是抽象的人、规范意义上的人。法律借助法人制度可以对现实生活中的团体进行符合法律要求的规制,以维护社会正义。

| Abstract: | Juristic person in law and groups in real life are not identical.The juristic person in law is an artificial person in law created by legal thinking.So,juristic person in law is abstract in normative sense.With the juristic person system law can be engaged to regulate groups in real life within the requirements of law to maintain social justice. |
