论不当得利的证明责任分配

按照不当得利制度要求,受害人主张返还利益时应当就无法律上原因的要件事实承担证明责任。然而,现实中不当得利的情形错综复杂,简单地适用划一标准分配证明责任可能会导致严重不公正现象的发生。通过比较分析证明责任的分配标准,我们认为应当区分不当得利的不同情形,针对给付型不当得利和非给付型不当得利及其各自特殊情形,适用不同的证明责任分配标准,完善我国的不当得利制度。

The Distribution of Burden of Proof in the System of Unjust Enrichment

According to the system of unjust enrichment,the victim should bear the burden of proof regarding to the fact without legal reason when demanding to return the interest.However,as the situations of unjust enrichment are intricate in reality,if we simply apply to uniform criterion,the unjust circumstances would happen.Through comparatively studying the norms of burden of proof,the legislators should distinguish the different situations of unjust enrichment.The law should distribute the burden of proof according to payment unjust enrichment and non-payment enrichment and its’ special situations in order to perfect the system of unjust enrichment.
