公司治理语境下“经济民主”的法律分析

经济民主的界定应从自由、平等和共生的基本理念出发,公司作为市场经济重要组成部分,其语境下的经济民主体现在一系列法律制度设计上,如股东权利表达体现了自由理念,中小股东保护体现了平等理念,职工参与公司管理体现了共生理念等等。就我国而言,现行《公司法》虽为经济民主的构建提供了一定的制度支撑,但如何更好实现仍然任重道远。
