本文运用历史唯物主义观点和法律人类学方法,结合田野工作的经验与感受,对中国少数民族习惯法的特性做了深入浅出的分析,并着重强调指出民族习惯法所具有社会性、乡土性、伦理性、民主性等特征,这对中国的法治建设特别是西部民族地区法制完善具有理论价值和实践意义.

A trail Discussion about the Nature of Ccstomary Laws of China's Minorities

This dissertation,based on historical materialism and anthropological jurisprudence,researches thoroughly the characteristics of customary law of China's minorities accordingt to field work.Furthermore,the author points out that its social,provincial,ethical and democratic characteristics are very important to China's rule by law,especially to the perfection of legal institutions in the ethnic regions.
