坚持程序公正与实体公正并重之我见——以刑事司法为视角

程序公正和实体公正各自有其内涵和独立标准.程序的价值首先在于保证实体价值实现的工具性,此外它还具有独立性、终局性和增加当事人对案件处理的实体结果的可接受程度等价值.对程序公正与实体公正的关系应当坚持并重理念,即应当从实际情况出发对两者的价值取向进行适宜的调整,保持动态的、辩证的平衡.二者不能有先后轻重之分,更不能搞程序本位主义.

On Emphasizing both the Procedural Justice and the Substantive Justice: As Viewed from the Criminal Judicature

The procedural justice and substantive justice have their respective connotations and independent criterions. The value of procedural justice consists in the instrumental value that guarantees the substantive merits, the independent and terminative value, and value of increasing the acceptability of the substantive result of a case. The notion that pays equal attention to the procedural justice and the substantive justice should be emphasized that the dynamic and dialectic balance between two aspects should be maintained and their value orientations should be adjusted appropriately according to the actual situation. None of them should be considered more important, and the conception of procedure-standard should not be advocated.
