行政公正与效率关系之探析

公正与效率的内涵是不同的。在行政法研究中,行政公正与效率的关系是一个重要的问题。公正与效率是行政法两个重要的基本价值范畴。二者首先是相辅相承、互相促进的,效率提高有利于公正在更大范围实现;公正是效率的根本保证。二者在一定程度上也存在冲突。协调这个冲突的途径是:正确处理依法行政与自由裁量的关系;保证行政程序正当;加强行政工作方式的改革与创新。

Analysis on the Relationship Between Administrative Justice and Administrative Efficiency

Justice and efficiency have different connotations.In the research of administration law,the relationship between administration justice and administrative efficiency is an important problem.They are two basic categories in administration law.At first,they complement each other so that higher efficiency is helpful to realize justice in wider area.Justice insures efficiency.However,they have sort of conflict.The way to solve it is to handle correctly the relationship between legal administration and discretionary judgment,guarantee the right administrative procedure and strengthen the reform and the innovation of the desk work.
