| 摘 要： | 不起诉决定确定力问题的关键在于该决定对起诉机关是否具有约束力。不起诉决定绝对具有确定力或不具有确定力都存在其难以克服的弊端。因此,应当将不起诉的理由作类型化的界分,从而根据理由的不同来分别规定不起诉决定是否具有确定力。

| Abstract: | The key issue of the finality of non-prosecution decision is whether it can prevent a second prosecution by the decision maker.To absolutely confirm or deny the finality of non-prosecution decision has its fatal defects.Therefore,we should analyze and separate the types of non-prosecution reasons,and the finality of non-prosecution decision should be determined differently upon the reasons for it. |
