| 摘 要： | 互联网知识产权侵权案件管辖权问题长期困扰各国司法实践。该问题的特殊性是和互联网的特性相关连的。传统侵权管辖权理论在互联网知识产权侵权案适用时面临着挑战,促使互联网知识产权侵权案若干管辖权新理论的产生,并积极探索解决互联网知识产权侵权案管辖权的方法和司法实践。

<td align="left" height="25" valign="top" nowrap><b>Abstract:</b></td><td width="92%" align="left" valign="top"><abstract>That jurisdictional problem of infringing case of internet knowledge property right is a perplexed problem in the judicial circles of all countries for a long time. It is related with the characteristics of internet. Jurisdictional theories of traditional infringement face the impacting phenomenon when applied and bring about the emergence of a new theory. Deciding on jurisdiction should consider some related factors, including the cooperations between sovereign states or regions. Be sure to cautiously use some excessive foudations of jurisdiction and to attach importance to technique development so as to solve the jurisdictional problem of the infringing case of internet knowledge property right .</td>
