| 摘 要： | 法律对公民通信自由通信秘密的限制应符合宪法规定及宪法精神。《监狱法》中关于服刑人员信件检查的规定与宪法相抵触,宪法并未授予监狱机关检查信件的权力,监狱机关以"有碍改造"作为扣留信件与宪法目的不符、理由也不充分,且所采取的检查手段缺乏合理依据,侵犯了服刑人员的通信自由与通信秘密受保护的权利。

| Abstract: | The legal restriction of the citizens＇ communication freedom shall abide by the constitution. This study believes checking prisoner＇ s correspondence collides with the regulations in constitution. On the other hand, the constitution doesn＇t endow the prison machinery the right to check private letters. ＂Obstruc- ting the reform of criminals＂ doesn＇ t excuse the machinery ＇ s detaining termers ＇ letters. Moreover the measures adopted to check the letters are unreasonable. Consequently the termers＇ freedom of communication and privacy are infringed. |
