我国产品责任的惩罚性赔偿制度研究

惩罚性赔偿是以损害补偿为核心的我国侵权责任法中的一个亮点,对大规模的产品侵权案件起到一定的遏制作用。我国侵权责任法增设了产品责任的惩罚性赔偿,但要求具备产品缺陷、产品生产者和经营者主观恶意及造成受害人死亡或严重的健康损害等要件。对于产品责任中的惩罚性赔偿数额我国法律还没有明确的规定,建议立法可以设定一些参考因素和上限数额,在弥补受害人损失、惩罚不法生产者的同时保证司法公正地实现。

On Punitive Damages of Product Liability in China

Punitive damages are the highlight in tort liability law in China which puts large-scale infringing products cases under control to some extent.But the punitive damages are on the condition that the product is defective,the product manufacturers and sellers cause the death or serious health damages out of malice.Meanwhile,the sum of punitive damages has not been specified.For the aim of compensating the victims,penalizing illegal manufacturers and guaranteeing justice,this paper suggests that reference factors and up-limit amount for punitive damages should be considered in the future legislation.
