| 摘 要： | 我国学者对何为刑事错案的问题存在着认识上的严重分歧,这显然不利于发挥理论对司法实践的明确指导作用。鉴于此,有必要厘清人们对刑事错案的模糊认识,探讨刑事错案产生缘由及其应对之策,为司法实践提供理论上的支持,尽可能地减少错案的发生,确保司法公正得以最大限度地实现。

| Abstract: | The Chinese scholars diverge in their definition of misjudged case and misjudged criminal case,which counteracts turning theory into judicial practice.Herein it is necessary to clarify the vague concept of misjudged criminal case,study its cause,and enact the policy of decreasing misjudged criminal case,which helps to reduce misjudged criminal case and achieve judicial justice by all means. |
