赎刑的废除与理性回归

从产生到废止,赎刑经历了两千多年的历史。在从身份社会到契约社会的历史变迁中,赎刑被新刑法典拒之门外。理性对待赎刑的态度,应该是批判地继承。应去除赎刑中的特权因素,继承赎刑中的理性成分,对赎刑进行符合时代精神的改造,使赎刑古为今用。

On Abolition of Redemption and Its Rational Revival

The redemption system has existed for more than two thousand years from promulgation to abolition. In the transformation from status society to contract society,it excluded out of the new criminal law. Actually,based on a rational attitude,the redemption system should be critically inherited,in which,the prerogative should be deleted while the rational elements inherited,conforming to the spirit of the era and making the old system better applied to present practice.
