论无权处分的认定

无权处分指处分人无权针对特定标的物实施的可能导致物权变动的处分行为,其内涵包含了物权变动的原因行为与结果在内。无权处分的认定关键在于处分人的处分权存在瑕疵,所有权人处分自己的财产亦可构成无权处分,《合同法》第五十一条的“无处分权的人处分他人财产”应当扩大解释为“无处分权的人处分存在他人排他性权利的财产”。无权处分的认定还应当区别于无因管理、无权代理等民事法律制度。

Discussing the Identification of the Ex Right Disposition

Ex right disposition means the disposer has no right to do the disposal behavior to the particular sub- ject, which may cause the real right change. Its connotation includes the reason of transfer of real right and the effects. The key to identify the ex right disposition is the defect of the person＇ s disposition. The owner dispo- sing their own property may also constitute ex right disposition. ＂Where a piece of property belonging to anoth- er person was disposed of by a person without the power to do so ＂ regulated in article 51 of the contract law shall be expanded as ＂Where a piece of property with exclusive rights belonging to another person was dis- posed of by a person without the power to do so＂. The identification of the ex right disposition should also be different from negotiorum gestio, unauthorized agency and other civil legal system.
