遏制冤案与本土司法资源发掘利用

我国当代刑事法体系以西方刑事法为蓝本,而西方刑事法体系对预防冤案的发生本身存在缺陷,很难应对中国刑讯逼供传统痼疾,冤案发生在所难免。我国古代刑事法诸多预防冤案的制度设计是精妙、有效的,诸如鼓励司法官员主动纠正错案的公事致错制度,案件审结时发挥纠察冤案作用的狱囚取服辩制度,纠正冤案的辨明冤枉制度,遏制冤案发生的官司出入人罪制度等为遏制刑讯引发冤案而设。这些制度在现代刑事法体系内是缺失的,借鉴、发掘本土司法资源中的优良制度,或许能为遏制冤案发生另辟蹊径。

On Checking Unjust Cases and Utilizing the Local Judicial Resources

The criminal law in the western countries is the blueprint of the contemporary criminal law system in China. But the western criminal law system has its own flaws in preventing errors from happening. And it is dif- ficult to deal with traditional Chinese torture ills, so unjust cases is inevitable. In ancient China, many systems for preventing unjust cases were designed subth and effectively. Some were specifically designed to prevent in- justice which would cause injustice torture. These systems are missing in modem criminal law system. Perhaps by learning and exploring the good systems in our local judicial resources, we can find another way to curb in- justice from happening.
