完善宪法有关中央军委之规定问题探讨

1982年12月4日,第五届全国人大第五次会议通过的《中华人民共和国宪法》（以下简称宪法）,在第三章“国家机构”中专设一节“中央军事委员会”,就此确立了中央军委在国家体制中的法律地位,并规定了它与国家最高权力机关的关系及其组成人员、任期等内容。宪法公布施行30多年来,围绕着中央军事委员会（简称中央军委）在宪法中所确立的地位和作用等问题展开研究的专门文章比较罕见,在思想认识和理论上存在着诸多误区。以完善宪法关于中央军委的规定为主旨,对此问题展开探讨很有必要。

On the Improvement of the Provisions about the Central Military Commission in the Constitution

On December 4,1982, ＂The Constitution of People＇s Republic of China＂ was adopted at the Fifth Meeting of the Fifth National People＇s Congress. In the third chapter of ＂national institutions＂, the ＂Central Military Commission＂ is set up to establish the legal status of the Central Military Commission in the national system, and it also provides its relationship with the country＇ s highest authority of their members, the term of office and other contents. With the implementation of the Constitution for 30 years, some different opinions have begun to emerge in both knowledge and theory. In this paper, the author tries to explore this issue in order to improve the provisions about the Central Military Commission In the Constitution.
