“标签理论”与“前科消灭”制度

为犯罪人贴上"罪犯"的标签,使其异于常人,是导致其再次犯罪的一个重要原因。基于这种分析,我们未来在制定有关预防犯罪的刑事政策时,应当考虑设立"前科消灭"制度,对于符合条件的犯罪人,将其前科记录销毁,去除贴在其身上的"罪犯"标签,以此达到减少其再犯可能性的目的。

Labeling Theory and System of Deleting Criminal Record

Labeling theory believes that attaching the label of criminal to those offenders, which distinguishes them from ordinary people, is a main cause of their recidivism. According to such analysis, while drawing up the criminal policy, we should establish a deleting system to obliterate the criminal records of the offenders who have matched certain preconditions, so as to lower the probability of their recidivism.
