| 摘 要： | 刑讯逼供是侦查程序中的一个顽疾,在国家尊重和保障人权的宪法原则下,对刑讯逼供证明责任的研究显得尤为重要。刑讯逼供的证明具有特殊性,这种特殊性使得对其事实的证明十分困难。因此,应当明确刑讯逼供的证明责任,以期对遏制刑讯逼供有所裨益。

| Abstract: | Extorting confessions by torture is a serious problem in the procedure of investigation.The study of the burden of evidence of extorting confessions by torture is essential under the constitutional principle of respecting and protecting human rights.There are particularities in proving the torture,so it is necessary to identify the burden of evidence of extorting confessions by torture in the hope that it can be beneficial in preventing this kind of illegal act. |
