| 摘 要： | 近年来,黑社会性质犯罪在我国一些地区呈现蔓延趋势,然而,目前人们在认识这种犯罪上仍存在着严重的分歧,给司法实践工作造成很大困难。鉴于此,有必要从犯罪构成的角度对黑社会性质犯罪的概念及其与有组织犯罪的区别加以辨析,揭示该种犯罪的本质、明确犯罪的构成要件,并据此制定和执行相应的法律规定。
