国际私法中的法律规避问题研究

法律规避在国际私法居于重要地位。从性质上看,法律规避制度应属于公共秩序保留制度的一部分。从效力上看,规避内国法应认定为无效;规避非特定的外国法应认定为有效,其中被规避的法律不仅应包括实体规范,还应包括冲突规范。正确认识法律规避制度的性质和效力等问题,在理论和实践上对正确处理我国国际私法上的法律规避问题具有重要的现实意义。

Studies on Evasion of Law in Private International Law

Evasion of law is very important in pr ivate international law.On the natu re,evasion of law should belong to the part of reservation of p ublic order.On the effect,evasion o f inland law should be clarified invalid.Evasion of general foreign law should be clarified valid.On theory and practices,correct com-prehension on system of the nature an d the effect of evasion of law will be b eneficial to deal with the issues of evasion of law in private international law in China.
