| 摘 要： | 过于依赖道德,囿于自律,是人治的突出特征.几千年人治政治的影响是中国当今廉政建设的障碍之一;而儒家人性理论是片面依赖道德自律的哲学基础,儒家夸大修养教化功能是依赖软约束的历史文化根源.当今中国反腐败的根本出路在于,通过深化改革,变道德依赖为制度依赖,变自律为主为他律为主,变人治为民主法治.

| Abstract: | Relying on moral self-discipline excessively is an obvious characteristic of rule by man.Thousands of years of influence of personal rule is an obstacle of constructing an honest and clean government in China.The philosophy foundation of relying on moral self-discipline is confucian theory of human nature.The essential way-out of anti-corruption in China is that relying on system replaces relying on morality,other-discipline replaces self-discipline,rule of law replaces rule by man,and so on. |
