滥用市场支配地位行为对竞争的影响分析

摘    要:滥用市场支配地位行为因具有严重的反竞争性而成为反垄断法规制的重要对象。依据行为的性质与目的不同,滥用市场支配地位行为可分为妨碍性滥用和剥削性滥用两大类,此两类滥用行为对竞争产生不同的影响。从滥用市场支配地位行为的具体表现形式看,主要包括掠夺性定价、瓶颈垄断、差别待遇、独家交易、搭售以及支配企业对包括供应商、顾客和最终消费者在内的各种交易相对人索取不合理的垄断暴利高价等;而各类中不同具体形式的滥用行为对竞争的影响也存在差异。

Abstract:The action of abusing the market ascendancy is the important control object of the anti-monopoly law because of its serious anti-rivalrousness.According to the different character and purpose,this action is divided into two kinds: impedimental abuse and exploitative abuse.They have different effect on the competition.The expressive modalities of this action mainly includes ravening price,bottleneck monopoly,discrimination,sole dealing and tie-in selling and the dominative enterprises try for the illogical long price.Certainly,the different kind of(abusing) action has the different effect on the competition.
