| 摘 要： | 宪政是依法治国的核心,而实行宪政的前提和基础是宪法具有正当性。这就要正确认识宪法的实质功能,保证宪法是具有正当性的良宪。西方启蒙学者和法学家揭示了宪法的实质功能即授予国家权力和限制国家权力。我们必须抛弃对宪法功能的错误认识。只有对宪法的实质功能有一个正确的认识,才能谋求依法治国,建设社会主义法治国家。

| Abstract: | Actualize constitution is the core of ruling by law.The foundation is that constitution is just.The western enlightment scholars and jurisconsults revealed that the virtual function of constitution is granted to empower and restrict power.In the modern age ,we must give up the old wrong idea of constitutional function.Correctly understanding it is important for our socialist ruling by law. |
