| 摘 要： | 劳动合同作为劳动法的重要组成部分 ,兼具公法和私法的特征 ,并较多地体现了私法的内容。我国劳动合同制度与《合同法》有天然的渊源关系 ,都是以合同的相对意思自治为基础建立的。市场经济下我国劳动合同制度的完善应注重劳动合同的私法性因素 ,在保持劳动合同特殊性的前提下考虑对《合同法》原理的适用。

| Abstract: | Labor contract, which is an important part in Labor Law, reflectsmore contents of the private laws. China's system of labor contract and Contract Law are both founded on the limited contract freedom doctrine. It is necessary to use the principles of Contract Law for reference in order to make the system of labor contract more perfect. |
