非物质文化遗产保护问题的法学界定

近几年,我国的文化遗产保护工作有了长足的进步和发展,特别是最近,非物质文化遗产的保护工程已进入到立法程序,法律草案几易其稿,然而学界仍争议纷呈,其焦点集中于对非物质文化遗产的概念、范围的界定。文章从法理学分析的视角出发,采用对比分析和归纳综述的方式,论证了对非物质文化遗产进行法学界定的缘由及意义,国际、国内非物质文化遗产概念的由来和变迁,在确定其概念的基础上,对保护主体、客体加以界定,以厘清立法时所要面对的具体问题。

On the Jurisprudent Definition of Issues Concerning the Protection of Intangible Culture Heritage

The project to protect the non-material cultural heritage has entered the legislative procedure and its draft has been rewritlen several times in recent years along with the rapid progress in the field in our country.But much controversy was evoked in academic circles,focusing on the definition of the concept and the scope of the heritage.Starting from the perspective of jurisprudence and adopting contrastive analysis and inductive aummarization,this paper is intended to verify the cause and significance to define the heritage by means of jurisprudence,with the origin and change of its concept traced at home and abroad,in order to clarify the questions in the making of the laws concerned on the basis of the conceptualization and the definition of the subjects and objects to be protected.
