| 摘 要： | 围绕刑事二审出庭，从检察人员出席二审法庭的法律地位争议，二审案件审判方式的确定及监督，二审案件开庭如何“参照”一审程序，二审证据的补查及对刑诉法第189条第3款的理解、运用和监督等几个方面深入探讨了检察人员出席刑事二审法庭过程中面临的诸多问题，并提出了相应的监督方法和解决对策。

| Abstract: | Surrounding the criminal appeal trial,the article deeply discusses several issues on prosecutors presenting the criminal appeal trial from the following aspects as the legal position of the prosecutor,the inquisition method choosing and supervising,the way of consulting the procedure of the first trial,evidence supplement of the second trial,comprehension,exertion and supervision of the article 189-3 of the Criminal Procedure Law,and supplies some profitable supervision methods and counter measures. |
