| 摘 要： | 国外及我国港澳台地区将交通肇事犯罪不仅规定在刑法典中,而且规定在一些行政法规里,对该类犯罪的处理方式也形式多样化。相比较而言,我国立法对交通肇事犯罪的规定存在缺陷,有必要修改我国的交通肇事罪,将逃逸行为独立出来,以不救助罪论处,这既有助于理解交通肇事罪,而且更易于处理指使逃逸行为。

| Abstract: | Traffic accident crime is stipulated not only in criminal codes,but in some administrative regulations in the other countries and in our country,Such as suchas,Hongkong,Macao and Taiwan,which can be settled by flexible ways.Compared to these countries and districts,there' re still defects in our legislation and it's necessary to amend this crime for better understanding of this crime and settling the escaping act. |
