| 摘 要： | 传统法理学将疑难案件当然地视为审判方法论的研究范畴,实际上这是一种误解,疑难案件不仅与审判方法论紧密相连,同时还不可避免地牵涉到法哲学的内容,此外它还是打通一般法理学与审判方法论的重要桥梁.

| Abstract: | In traditional jurisprudence hard cases are treated as a part of trial methodology with certainty, as a matter of fact, it is a misconception. Hard cases are not only closely linked to trial methodology, but also inevitably involved with the content of legal philosophy. In addition, they are a bridge which breaks through the general jurisprudence and trial method- ology. |
