北京市人民检察院第二分院附条件逮捕案件分析

2006年北京市人民检察院第二分院开始适用附条件逮捕以来,取得了比较好的法律效果和社会效果,通过对近两年适用附条件逮捕的基本情况进行统计分析可以看出,该机制对于保障重大案件刑事诉讼的顺利进行、强化侦查监督等方面具有积极意义;同时,该机制目前也还存在适用范围不明确且有扩大适用的趋势、个别案件逮捕标准被不当降低、决定程序不严谨、长期羁押等问题.
