论技术侦察及获取证据的法律适用

技术侦察是 2 0世纪二三十年代伴随着科学技术的进步 ,以及犯罪的智能化、隐秘化和组织化而出现。刑侦实践证明 ,运用技术侦察是打击严重刑事犯罪有效而且必要的手段。但由于我国刑事诉讼法没有对技术侦察加以规定 ,因此对技术侦察手段及获取证据的合法性问题 ,诉讼法学界有不同的认识。根据《人民警察法》的规定 ,技术侦察的合法性是不容置疑的 ;为了保护公民的合法效益 ,更有效地发挥技术侦察在刑事诉讼中的作用 ,立法应明确规定技术侦察是一种法定的侦查手段 ,并对其适用原则、条件和程度作出具体规定。

APPLICATION OF LAW IN TECHNICAL INVESTIGATION AND PROCUPEMENT OF EVIDENCE

In 20s and 30s of the 20th century,with the progress of science and technoledge and crimes being conducted in an intellectual,secret and organized way,tehnical investigation then came into birth.The practice in criminal investigation has proved that technical investigation is a powerful means to crack on serious criminal crimes.But due to the fact that Law of Criminal Procedure in China doesn't make any regulations over technical investigation, different understandings prevail in the circle of procedure law as to the legitimacy of the means of technical investigation and procurement of evidence .According to stipualtions made by Law of People's Police,technical investigation is undoubtedly legitimate.In order to protect citizens' legal interests and give play technical investigation in a more efficient way during the handling of criminal cases,law should be formulated to definitely stipulate techoical investigation is a kind of legitimate nivestigation means and to prescribe as well concrete regulations over applied rules,conditions and degrees.
