侦查认识原理初探

侦查认识原理既包括侦查认识活动最基本的客观规律，也包括根据最基本的规律而制定的侦查认识的基本方法和基本原则。研究侦查认识原理的意义是多方面的，而这一主题在中外侦查学著作中都只简单地提到，而尚未进行充分地挖掘。探索侦查认识原理应当从侦查认识的基本假设入手，根据侦查认识活动的本质提出侦查认识的三大原理，继而根据侦查认识的三大原理设立评价侦查认识结果的标准，最后根据三大原理和标准设计克服侦查认识错误的对策。

Preliminary Inquiries on Cognitive Principles in Criminal Investigation

Cognitive principles in criminal investigation include both the fundamental laws in criminal investigation and the basic methods and doctrines which are produced according to the fundamental laws. There are many meaningful aspects of researching cognitive principles in criminal investigation. But this topic is simply mentioned and not yet comprehensively researched in the Chinese or Foreign academic works on criminal investigation. Studying in cognitive principles in criminal investigation has to begin with the basic assumption of cognition in criminal investigation; the three cognitive principles should be derived from the natures of cognition in criminal investigation; the criteria by which the consequences derived from cognition in criminal investigation were evaluated were built according to the Three principles; eventually, the schemes by which the errors in criminal investigation were decreased were designed according to the Three principles and the criteria.
