| 摘 要： | 主观恶性是刑事责任的根据,犯罪人格是刑事责任的基础。其符合我国刑法的规定,能够说明犯罪与刑事责任之间的内 在联系,还体现了主观与客观,行为与行为人的统一,能说明刑事责任的质与量,比人身危险性根据论更科学和实证。
