| 摘 要： | 由于缺乏法律的明确规定,作为单位犯罪刑罚主体的“直接负责的主管人员”以及“其他直接责任人员”在理论和实践中都存在较大争议,这种情况不仅严重影响了对单位犯罪的打击力度,而且还会破坏法制的统一,需要认真研究。

| Abstract: | Owing to the reason of lacking clear judicial definition,currently there exist great arguments both theoretically and practically in determining "direct supervisor liable" and other "direct person liable" in crimes committed by units.The above fact can not only greatly impair the fight against unit-committed crimes but also damage the unification of the legal system,which should be thoroughly studied. |
