| 摘 要： | 本文主要通过比较犯罪学和刑法学在看待犯罪主观心态上的差别，推导出犯罪学特有的研究侧重，即在故意和过失、直接故意和间接故意、目的和动机等方面上的研究重点，进而重申犯罪学学科的独立性。
