| Abstract: | Possession is derived from human's instinct of chasing interests. Legal interest is the production of law's balancing which is also the matrix of right. It can translate into right if conditions permit. Quality of possession isn't fact. It is legal interest. Possession in our civil code should be determined as legal interest. Lacking proper conditions, it could not translate into right. |
