The theoretical studies of organized crimes started with an awful embarrassment: the difficulty in the establishment of the concept. This article, based on a review of the research findings in this area, highlights the theoretical straits and points out that the way out is to interpret the concept of organized crime from a dual viewpoint of both criminal law and criminology. It goes on to provide a detailed analysis of the theoretical grounds, functions and contents of this dualism.
