| 摘 要： | 本文从四个方面论述了司法假言命题构建的问题,即根据靠件的容观实际构建假言命题;根据犯罪构成理论构建假言命题;根据法律规定构建假言命题;根据假言命题自身的特点构建假言命题。如果从以上四个方面构建假言命题,那么就可以为司法假言推理提供真实的假言前提,从而保证结论的正确性。

| Abstract: | This article proposes the construction of hypothetical preposition from four aspects: the facts of a case; the theories of the composition of a crime; the legal prescriptions and the characteristics of hypothetical preposition. It holds that hypothetical prepositions formed this way are sound enough to provide authentic hypothetical prepositions for judicial reasoning and guarantee for the correctness of conclusions. |
