| 摘 要： | 已经存在半个多世纪的劳动教养制度,为我国社会与政治稳定作出了积极贡献。但随着我国政治、经济和社会的急剧发展和变革,劳动教养制度存在的立法、司法及价值观念三维缺陷更加突显,亟需对其理性重塑,以期最大化地发挥其制度理性。

| Abstract: | The reeducation-through-labor has been being for half a century and made a positive contribution to Chinese social and political stability.However,the legislative,judicial and values' defects become serious along with rapid Chinese political,economic and social development.It is urgent to remodel the reeducation-through-labor system to maximize its rationality. |
