论跨行政区流域生态补偿的社会属性-基于流域生态补偿法律制度建构的现实立场

跨行政区流域生态补偿关系主体多元，而且主体间具有网络化特性、交互性、内容多样性。流域生态补偿之所以必要，其核心原因在于流域经济、社会和环境要素结构不平衡，流域不同区位利益分享或流动机帝J失范。社会性属性应该是生态补偿尤其是跨行政区流域生态补偿的本质属性，跨行政区流域生态补偿本质上是发展权益补偿和平衡。跨行政区流域生态补偿法律机制建构应该突出社会性的“约定”机制。“约定”机制符合社会规律与实践经验、是程序性机制、是跨行政区流域生态补偿利益相关者的广泛参与机制。“约定”机制需要配套机制建设，尤其是国土功能规划以及产业发展布局规划机制、流域信息交流机制、流域生态价值评估机制等。
