名人做虚假广告法律问题研究

摘    要:关于名人做广告的话题,近些年来一直是新闻传播界讨论的热点。名人做虚假广告已屡见不鲜,由此引发的潜在社会危害性不可低估,众多消费者因名人效应而屡屡上当受骗,司法实践中也曾出现状告名人的现象,但名人对此是否应负法律责任众说不一,该问题还未引起法学界足够的关注。文章旨在通过对名人做虚假广告的虚假性识别、承担法律责任的理论基础及对消费者的救济途径等相关法律问题的探讨,以期能引起法学界的重视和深入研究。

Abstract:The topic of celebrities engaging in false advertisement has been popular in the media circle in recent years. Because celebrities engaging in false advertisement often occur, the potential social harm couldn't be underestimated and many consumers have been duped and misled. Celebrities occasionally sued for this, but there is no consensus of opinions on celebrities' legal liability and the legal circle has not paid enough attention to this. The author aims at bringing about the law circle's emphases and studying deeply through the discussion of the correlative legal problems about identifying the falsehood of celebrities engaging in false advertisement, the academic basis on bearing legal liability and the methods of relieving consumers etcs.
