我国ISP版权侵权责任的立法现状与立法建议

在所有关于网络版权侵权的法律问题中,网络服务商的版权侵权责任问题是国内外争论最激烈,立法进程最快的一个方面。笔者提出了应当对中国现行著作权法进行修改与完善以增加网络服务商版权侵权责任的建议。同时,也具体地提出了在著作权法中应当明确规定网络内容提供者与在线服务商适用不同的归责原则、著作权法中应当明确规定在线服务商享受责任限制待遇的资格、条件、规定OSP负有协助版权人查找直接侵权行为人的义务等几点的具体的立法建议。

The state of legislation of ISP copyright infringement liability in China and legislative proposals

In all legal issues on the Internet copyright infringement,the responsibility of copyright infringement of Internet service providers is the most intense controversy at home and abroad, and the fastest legislative process.The author put forward the proposal that we should revise and improve China's current Copyright Law,to increase copyright infringement liability of Internet service providers.Meanwhile,the writer also made a few specific legislative proposals, such as in the Copyright Law,the content of network providers and online service providers apply different original attribution should be specified,the restrictions and conditions the online service provider liability for the treatment of eligibifity should be specified and OSP has the obligations to help search for direct copyright infringement.
