论国际条约在中国的适用

国际条约如何适用于国内,各国立法、实践不一,而我国对这一问题尚无明确、统一的宪法性规定。因此,构建一套以宪法性规范为核心的条约适用制度已成为必要。建立中国的条约适用制度必须坚持国家主权原则和条约效力优先原则相结合,以专门性立法的形式明确不同层次条约的地位及效力,并对条约的适用方式做出灵活简便的规定。

Preliminary Discussion on Application of International Treaties in China

There are different practice and legislation on appilcation of international treaties by various countries of the world.In China there are no constitutional provisions concerning the question.So it is necessary to set up a system of treaty application,the core of it is constitutional norms.We must insist on uniting the principle of state sovereignty and the principle of priority of treaty.Effective procedure of treaties,status and validity of treaties,and the applicable method of treaties,should be expressly presented with special law.
