我国电子商务立法问题探析

国际电子商务如火如荼 ,国内立法刻不容缓 ,我国学者却多主张修订传统贸易法律 ,扩大司法解释和法律定义解决电子商务之法律问题。本文在分析国际电子商务立法趋势 ,指出我国电子商务立法滞后的基础上 ,针对当前理论界存在的模糊认识及国际电子商务立法与我国传统贸易法律的冲突 ,提出相应的改进意见

Study and Analysis on Legislation in E- commerce in China

WT5BZ]With the rapid development of e-commerce,of which the legislation is of great urgency,most scholars of our country maintain that legal problems can be solved by revising the traditional trade law.enlarging judicial interpretation and legal definition.This Paper,after analzing the legislation trend of the international e commerce,raising the legislation backwardness in our eountry,puts farward some corresponding suggestion in regord to the confused knowledge of it and the conflict between international e-commerce legistation and our traditional trade law.
