| 摘 要： | 刑法理论界与实务部门对挪用犯罪的主体范围、客观方面、法律适用、罪与非罪、此罪与彼罪等问题认识不一,导致了司法实务中适用的诸多问题。有鉴于此,我们从理论与实践的结合上,着重对挪用私营企业资金、挪用特定款物给外单位使用、挪用公款的主体范围、客观方面、此罪与彼罪等问题进行探讨,以增强对司法实务的指导作用。

| Abstract: | There are different viewpoints about the subject of crime,subjective aspects,the application of law,crime and non-crime,this crime and that crime,etc.of the misappopriation crime,which cause many problems in judicative practicing.Then we emphasize to analysis he subject of crime,subjective aspects,the application of law,crime and non-crime,this crime and that crime,etc.of the misappopriation crime about funding of private enterprise,the special funding and material of misappopriation for others' use,public founding of misappopriation to enhance the leading effect on judicative practicing. |
