| 摘 要： | 在毒品犯罪案件的侦查中,诱惑侦查是一个使用频率较高的侦查方法,对于通过诱惑侦查措施所侦破的毒品犯罪案件,如何对被引诱人的行为作出正确的定性,是一个很有争议的问题,一般来讲,对于通过机会提供型诱惑侦查措施所破获的案件,对被引诱人应以犯罪未遂论处,而对于犯意诱发型诱惑侦查措施所破获的案件,则要根据情况区别对待。
