欧盟《分时度假指令》研究

<欧盟分时度假指令>经过成员国的转换,成为成员国规制分时度假市场的重要立法.尽管它对分时度假的市场秩序起到一定的规范、整顿作用,但指令只是对分时度假提出最低限度的要求,且对分时度假的界定过于严格,以致没有实现保护分时度假及类似产品的消费者的预期目的.介绍了指令的出台背景、内容,并作出相应评述,以为我国将来立法提供前车之鉴.

Study on EU Timeshare Directive

Transformed by the member countries, EU Timeshare Directive has become an important legislation in regulating timeshare market. Although the directive plays a role in adjusting and standardizing market order, it only brought forward the lowest requirements to timeshare. In addition, the directive defines the timeshare too strict, with the result of not protecting timeshare and not satisfies consumers' expectation to its corresponding products. This paper introduces the background and content of the directive and presents relevant comments, aiming at offering some lessons and suggestions for the legislation in China in the future.
