| 摘 要： | 侦查程序中犯罪嫌疑人与被害人人权保障平衡具有法理上的正当性。我国侦查程序中犯罪嫌疑人人权保障与被害人人权保障之间存在失衡的状态,如何在侦查需要与人权保障之间实现动态平衡的大前提下,努力实现犯罪嫌疑人人权保障与被害人人权保障之间的动态平衡,仍是一个需要认真加以探讨的重要课题。

| Abstract: | Balance of the human rights of the suspect and the victim in a criminal investigation is justified in legal philosophy.However,such a balance seems to have been disturbed a little bit in China now and thus how to keep the human rights of the suspect and the injured equilibrium still remains a topic worth of full deliberation. |
