摘    要:目前,我国尚无不动产强制拍卖相关立法,强制拍卖的性质亦未有定论.法院在拍卖债务人以外第三人不动产时,不具体区分拍定人的善意或恶意,严重忽视不动产第三所有人的保护和救济.因此,在不动产强制拍卖立法中,应扩张善意取得制度,建立健全不动产第三所有人救济制度,通过拍卖程序终结之前的程序保障、拍卖程序终结之后的实体救济对不动产第三所有人予以保护.

Research on Some Issues of Real Estate Mandatory Auction

Abstract:At present,there is not correlative legislation on mandatory auction of real estate in our country,and the quality of mandatory auction has not a doubtless verdict.When court auctions the real estate which beyond the liability limit of debtor's possessions belong to the third ones,they do not distinguish goodwill or malice of the bargainee,and neglect to protect the third ones' real estate property.Therefor,in the legislation on mandatory auction of real estate,it is necessary to expand the bona fide acquisition system,constitute and perfect the remedy system to the third ones'real estate property,and take the two steps,involving the process guarantee before expiry of auction process and the entitative remedy after the expiry of auction process to protect the third ones' real estate property.
